Parties wishing to obtain further information on and potentially to participate in the EDF generation capacity auctions are encouraged to register their interest sufficiently in advance of the deadline for application to qualify for the auction to enable them to review fully the documentation for that auction.
Parties wishing to register their interest in an auction must enter into a Registration Agreement with EDF and its advisors. As part of the Registration Agreement, each party must notify EDF that it is a competitor energy utility and/or energy trader and that it belongs to one or more of the following categories:
(a) generators registered in France and/or their subsidiaries registered in France (French wording to use for the French version of the Agreement: “un producteur enregistré en France et/ou une de ses filiales enregistrée en France”);
(b) suppliers registered in France (French wording to use for the French version of the Agreement: "les fournisseurs enregistrés en France exerçant l'activité d'achat pour revente aux clients éligibles");
(c) French distribution companies (in order to resell to their eligible clients) (French wording to use for the French version of the Agreement: “une société française de distribution (dans le but de revendre à ses clients éligibles)”);
(d) generators and suppliers registered in a Member State of the European Economic Area other than France, or, within the framework of relevant international agreements, in any State outside the European Economic Area which is connected to the French electric system (or those who expect to be so by the time of the Auction for which they intend to qualify)(French wording to use for the French version of the Agreement: “un producteur ou fournisseur enregistré dans un Etat membre de l'Espace Economique Européen autre que la France ou, dans le cadre des accords internationaux applicables, dans quelqu'Etat hors de l'Espace Economique Européen qui serait connecté au réseau électrique français (ou encore une société qui anticipe de remplir ces conditions d'ici à la date des Enchères pour lesquelles elle compte se qualifier”);
(e) energy trading companies registered in a Member State of the European Economic Area or, within the framework of relevant international agreements, in any State outside the European Economic Area which is connected to the French electric system (or those who expect to be so by the time of the Auction for which they intend to qualify). (French wording to use for the French version of the Agreement: “une société de négoce d'énergie enregistrée dans un Etat membre de l'Espace Economique Européen ou, dans le cadre des accords internationaux applicables, dans quelqu'Etat hors de l'Espace Economique Européen qui serait connecté au réseau électrique français (ou encore une société qui anticipe de remplir ces conditions d'ici à la date des Enchères pour lesquelles elle compte se qualifier”).
Those parties wishing to enter into a Registration Agreement with EDF and its advisors must sign the French version of the Agreement, and may in addition, if they wish, sign the English version of the Agreement. If both versions are signed, both are legally valid, but, in accordance with French Law, in the event of a discrepancy, the French version shall prevail.
